Most people buying land in Lombok ask two questions: how big is it, and how much does it cost? Those are the wrong two questions to lead with.

The questions that actually determine whether a piece of land is safe to buy are these four: what does the certificate actually say, is it zoned for what you intend to build, is the tax history clean, and do you have legal — not just verbal — access to reach it. Get all four answered in writing before you sign anything. Skip even one, and you can end up owning land you cannot legally develop, cannot legally reach, or cannot legally keep.

Check 1 — Certificate & Title

Before anything else, establish exactly what kind of certificate the land holds — because in Indonesia, not every certificate grants the same rights, and some aren’t available to foreign buyers at all.

SHM (Sertifikat Hak Milik — freehold title) is reserved for Indonesian citizens. As a foreign buyer, you cannot hold SHM directly, regardless of what any agent tells you.

HGB (Hak Guna Bangunan — Right to Build) is what a PT PMA (Perseroan Terbatas Penanaman Modal Asing — a foreign-owned limited liability company) holds. If you’re structuring your purchase through a PT PMA — the standard route for investment property — this is the title your company will be issued. It is fully legal and grants full commercial development rights.

Hak Pakai (Right of Use) is a more limited title generally suited to personal residential use, available to foreigners holding a valid KITAS (temporary stay permit).

Whichever certificate type applies, it must be physically verified at the BPN (Badan Pertanahan Nasional — National Land Agency) office in Lombok Tengah before you proceed. Four things to confirm:

  • Is the certificate authentic?
  • Does the registered owner’s name match the person selling it to you?
  • Are there any existing mortgages (Hak Tanggungan) registered against the title?
  • Do the physical boundaries match what’s recorded on the certificate?

This one step has killed deals that looked completely clean on paper. A certificate that reads well is not the same as a certificate that’s been verified. Budget the time — it’s the most important twenty minutes of the entire buying process.

Land sitting in a place that feels like a tourism area isn’t necessarily zoned for tourism development. Zoning in Lombok is controlled by Dinas PUPR and BAPPEDA Lombok Tengah, and the document that actually determines what you can build is the RDTR (Rencana Detail Tata Ruang — Detailed Spatial Plan).

If the land is zoned for tourism, you can build a villa, guesthouse, or resort. If it’s zoned agricultural or green belt, you cannot legally develop it for tourism use — there is no workaround, no informal arrangement that holds up over time.

If you’re evaluating land near Mandalika, there’s an additional layer: the Special Economic Zone (SEZ) carries its own rules on top of standard zoning classifications, so both need to be checked.

What to ask the seller: request the official zoning letter from PUPR directly. If they can’t produce it, treat that as a red flag rather than a formality to chase down later.

Property tax in Indonesia doesn’t work the way it does in most countries — and this catches out a meaningful number of first-time foreign buyers.

PBB (Pajak Bumi dan Bangunan — Land and Building Tax) is an annual tax, and critically, unpaid tax debt attaches to the land itself, not to the person who owed it. If the previous owner didn’t pay PBB for five years, that debt transfers to you along with the title.

Request Bukti Lunas PBB (proof of payment) for a minimum of five years — actual receipts, not a verbal assurance that everything’s been handled.

The second part of this check is Hak Tanggungan — a formal mortgage registered against the land as loan collateral. If Hak Tanggungan exists and hasn’t been formally released through a process called Roya, the title legally cannot be transferred to you, regardless of what both parties want.

Two questions cover this entire check: five years of PBB receipts, and confirmation there’s no outstanding Hak Tanggungan.

The final check covers three related risks: how you legally reach the land, whether its boundaries are accurately recorded, and whether anyone else has a competing claim to it.

Access. What you need is Hak Jalan — a registered legal right of way. A verbal understanding with a neighbor that you can cross their land is not legal access; it’s a favor, and favors end. If that neighbor later sells and fences their property, you can find yourself owning land you have no legal way to reach.

Boundaries. Pull the cadastral map from BPN and confirm it matches physical boundary markers — patok — actually placed on-site. Paperwork boundaries and physical boundaries don’t always agree, and the gap between them is far cheaper to resolve before you buy than after.

Disputes. Inherited land requires sign-off from every heir, not just the family member negotiating the sale. It’s also worth a direct conversation with the Kepala Desa (village head) — they typically know a land parcel’s real history, including disputes that were never formally documented.

If you’re dealing directly with a landowner rather than through an agent, having the right questions ready in Bahasa Indonesia changes the conversation. This isn’t a stiff literal translation — it’s the phrasing a local buyer would actually use.

1. Sertifikat & Kepemilikan (Certificate & Ownership)

“Bapak/Ibu, boleh saya melihat sertifikat tanah aslinya? Sertifikat ini jenisnya apa — SHM, HGB, atau Hak Pakai? Nama yang tertera di sertifikat apakah sama dengan nama Bapak/Ibu sebagai penjual? Apakah tanah ini sedang dijadikan agunan pinjaman di bank atau lembaga keuangan lain? Apakah ada blokir atau sengketa yang sedang berjalan di kantor BPN/ATR atas tanah ini?” (May I see the original land certificate? What type is it — SHM, HGB, or Hak Pakai? Does the name on the certificate match your name as the seller? Is this land currently used as collateral for a loan at any bank or financial institution? Is there any hold or dispute currently active on this land at the BPN/ATR office?)

2. Zonasi & Tata Ruang (Zoning & Spatial Planning)

“Menurut dokumen resmi, tanah ini masuk dalam zona apa — zona pariwisata, permukiman, pertanian, atau lainnya? Apakah Bapak/Ibu memiliki surat keterangan zonasi dari Dinas PUPR atau BAPPEDA Lombok Tengah? Apakah tanah ini sudah bisa langsung digunakan untuk membangun villa, penginapan, atau usaha komersial?” (According to official documents, what zone does this land fall into — tourism, residential, agricultural, or other? 3. Pajak & Beban Keuangan (Tax & Financial Obligations)

4. Akses Jalan, Batas Tanah & Sengketa (Road Access, Boundaries & Disputes)

Apakah batas-batas tanah ini sudah sesuai dengan peta kadaster di BPN? Apakah tanah ini pernah atau sedang dalam sengketa? Apakah semua ahli waris sudah menandatangani persetujuan untuk menjual?” (Is the road access to this land officially registered as Hak Jalan, or only based on a verbal agreement with a neighbor? Do the boundaries of this land match the cadastral map at BPN? Has this land ever been, or is it currently, in a dispute? Have all heirs signed their agreement to sell?)


Frequently Asked Questions

What happens if a seller can’t produce a clean answer on one of the four checks?

Treat it as information, not an obstacle to solve for them. A seller unable or unwilling to produce documentation on certificate, zoning, tax, or access is telling you something about the deal — proceed with independent verification through your own notaris (Indonesian notary) before committing any funds.

Do I need a notaris for all four checks, or can I verify some of this myself?

You can and should ask these questions directly, but formal verification — particularly of the certificate at BPN and the tax clearance — should be confirmed through a licensed notaris independent of the seller. Never use a notaris the seller recommends.

Does this checklist apply to Hak Sewa (leasehold) purchases too?
